Terms of Service

1. Acceptance of terms
By creating an account or using SWIZ OS, SWIZ X, or any other SWIZSOFT service, you agree to be bound by these Terms of Service. If you are using our services on behalf of a company, you confirm you have authority to bind that company to these terms.
2. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate registration information and be at least 18 years old. Notify us at support@swizsoft.com if you suspect unauthorised use of your account.
3. Subscriptions & billing
Paid plans are billed on a recurring monthly basis through our payment processor, Paddle, unless otherwise stated at checkout. Prices are shown in USD and may be subject to applicable tax. You authorise us to charge your chosen payment method automatically at each billing cycle until you cancel.
4. Refunds & cancellation
You may cancel at any time from your account settings; access continues until the end of your current billing period, and you will not be charged again after cancellation. Fees already paid are generally non-refundable except where required by law or expressly stated at purchase. If you believe you were charged in error, contact support@swizsoft.com within 14 days of the charge.
5. Acceptable use
You agree not to use our services to:
- Violate any applicable law or regulation;
- Submit content that is unlawful, fraudulent, or infringes another party’s rights;
- Attempt to reverse-engineer, disrupt, or gain unauthorised access to our systems; or
- Resell or sublicense access outside of an authorised agency or partner plan.
We may suspend or terminate accounts that violate this section.
6. AI-generated content
SWIZ OS and SWIZ X use artificial intelligence to generate suggestions, filings, advertising content, and reports. AI-generated output may contain errors and should be reviewed before you rely on it — particularly tax and compliance suggestions from SWIZ OS, which do not constitute professional tax or legal advice. You remain responsible for reviewing and approving AI-generated content before acting on or publishing it.
7. Content ownership
You retain ownership of the content you submit to and generate through our services, including ad copy, scripts, filings, and business data. You grant us a limited licence to process that content solely to provide and improve our services. We claim no ownership rights over your business data or generated content.
8. Service availability
We aim to keep our services available and reliable, but we do not guarantee uninterrupted access. We may perform scheduled maintenance, and services may occasionally be unavailable due to circumstances outside our control. Enterprise customers with a signed SLA are governed by that agreement where it conflicts with this section.
9. Limitation of liability
Our services are provided “as is” and “as available,” without warranties of any kind, express or implied. To the maximum extent permitted by law, SWIZSOFT and its affiliated entities are not liable for indirect, incidental, or consequential damages, including lost profits or business losses arising from your use of AI-generated content, tax filings, or advertising campaigns produced through our services.
10. Termination
You may stop using our services and close your account at any time. We may suspend or terminate your access if you breach these terms, fail to pay applicable fees, or where required by law. On termination your right to use the services ends immediately; provisions covering ownership, liability, and governing law survive termination.
11. Governing law
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law principles, unless you are contracting with a regional SWIZSOFT entity under a separate agreement that specifies otherwise. Disputes will be resolved in the courts located in Texas, United States, unless otherwise required by applicable consumer protection law in your jurisdiction.
12. Changes to these terms
We may update these terms from time to time. Material changes will be reflected by an updated date at the top of this page, and where required by law we will provide additional notice. Continued use after a change constitutes acceptance of the revised terms.
